THIRD AMENDMENT TO DECLARATION OF CONDOMINIUM ESTABLISHING CASTLE BEACH CLUB, A CONDOMINIUM

WHEREAS, the Declaration of Condominium establishing Castle Beach Club, a Condominium, was recorded on November 16, 1991, in Official Records Book 15285, at Page 1869, of the Public Records of Dade County, Florida (the "Declaration"); and,

WHEREAS, Article 9.02 of the Declaration provides as follows:

WHEREAS, Article 9.02 of the Declaration permits such an amendment to change a Common Element to a Limited Common Element; and,

WHEREAS, at this time, the Developer is entitled to appoint a marjority [sic] of the Board of Developers [sic]; and

WHEREAS, the Association desires to change a Common Element to a Limited Common Element as set forth on the Exhibits attached hereto.

1. A Limited Common Element for Commercial Unit 19 is hereby created as set forth on revised Sheets 1 and 5 of 40, attached hereto as part of Exhibit "A".

2. A Limited Common Element for Unit 622 and Unit 623 is hereby created as set forth on Revised Sheets 2 and 8 of 40, attached hereto as part of Exhibit "A".

3. Exhibit "B" to the Declaration is deemed to be revised in accordance with Exhibit "A" attached to this Amendment.
